The terms that apply to bookings and delivered work.

Working with Mistry Arts
These terms apply to all quotes, bookings and delivered work with Mistry Arts Ltd (Company No. 13861026, VAT No. GB403601938), referred to below as "we", "us" or "Mistry Arts". "You" means the person or organisation who accepts a quote or confirms a booking. These terms apply unless otherwise agreed in writing, and by accepting a quote or confirming a booking, you agree to them.
Quotes & project scope
Quotes are based on the brief discussed at the time and are valid for 30 days from the date they're issued. If the scope changes — extra filming days, additional edits, a different brief — the quote will be updated to reflect that before any extra work begins.
Coverage on the day is guided by professional judgement and the brief agreed in advance. Every effort is made to capture the moments that matter, but filming is subject to access, timing and conditions on the day, and specific individual moments can't be guaranteed.
If a project stalls because footage, materials, sign-off or information needed to finish it haven't been provided, and there's no response from you for 6 months, the project is treated as closed. Picking it back up after that point may need a new quote for any outstanding work.
Booking & payment
A deposit of 50% of the agreed fee is required to secure a booking, with the date held only once the deposit is received. The remaining balance is due on delivery, unless a different schedule is agreed in writing for larger projects.
Invoices are payable within 14 days unless agreed otherwise. For business clients, the Late Payment of Commercial Debts (Interest) Act 1998 entitles us to charge statutory interest and a fixed compensation fee on overdue invoices, and we reserve the right to do so. Delivered files remain for review only, and full usage rights are granted once payment is received in full.
If you're booking as an individual consumer rather than a business, and the booking is made at a distance — for example through the Start a Project form, by email or by phone, without meeting in person — the Consumer Contracts Regulations 2013 may give you a 14-day right to cancel. Where a shoot is booked to take place within that 14-day period, we'll ask you to confirm in writing that you're happy for work to begin sooner; doing so means that right to cancel ends once the shoot has taken place.
Expenses
Travel, parking, and any specialist equipment or crew required for a project are quoted separately or added to the final invoice, and agreed with you in advance wherever possible.
Revisions
Quotes include two rounds of revisions on the edited work, each covering a single consolidated set of notes. Further changes beyond this, or changes that go beyond the original brief, are chargeable at an hourly rate, agreed with you before any extra work starts.
Cancellations & rescheduling
- More than 14 days' notice: no charge
- Between 48 hours and 14 days' notice: 50% of the agreed shoot fee
- Within 48 hours' notice: 100% of the agreed shoot fee
Any third-party costs already committed (crew, kit hire, locations) may still be chargeable regardless of notice given. Where a shoot needs to be rescheduled for reasons outside either party's reasonable control — illness, severe weather, travel disruption, government restrictions or similar — this is treated separately from the cancellation charges above, and a new date is found wherever possible at no extra charge.
Delivery & ownership of footage
Copyright in footage and photographs produced under these terms remains with Mistry Arts Ltd, under the Copyright, Designs and Patents Act 1988's default position for commissioned creative work. On full payment, you're granted a licence to use the delivered work for the purpose agreed at booking — for example, your own marketing, social media, or internal use. Full copyright assignment is available only where separately agreed in writing, typically at an additional fee.
Where music is needed for the finished piece, royalty-free or properly licensed tracks are used by default. If you'd like a specific commercial track included instead, securing the sync licence for it is your responsibility.
Raw, unedited footage is not included unless specifically agreed in writing. Mistry Arts may use short clips or stills from a project for its own portfolio, website and social media, unless you request otherwise in writing.
You are responsible for backing up delivered files. Project files are kept for up to 6 years from project completion, after which they may be archived or deleted without further notice.
Client responsibilities
You confirm that any material you provide (logos, music, footage, branding) is either owned by you or properly licensed for use, and that you have obtained any necessary permission or model releases from people appearing in the finished work, unless otherwise agreed. Where filming or photography takes place at a venue or location you've arranged, you're responsible for securing any necessary access, filming permits or other third-party permissions for that location, and for any fees the venue charges. You'll also provide a safe working environment for filming. You agree to cover any claims, losses or costs Mistry Arts incurs as a result of client-supplied material, a failure to obtain the right permissions, a lack of authorisation to film or photograph at the agreed location, or damage to Mistry Arts' equipment caused by your guests, staff or the venue.
Blog, editorial content & trademarks
Product names, logos and trademarks referenced in blog posts or elsewhere on this website — including but not limited to Apple, iPhone, Nikon, RED Digital Cinema and DJI — are the property of their respective owners. They're used here for identification and editorial purposes only, to refer accurately to the products discussed. Mistry Arts Ltd is not affiliated with, sponsored by, or endorsed by any brand or manufacturer named in blog content or elsewhere on this site, unless a post explicitly states otherwise.
Blog posts reflect Nitesh Mistry's independent opinions, research and, where stated, personal hands-on experience with the products discussed. Specifications, prices, release dates and features mentioned are based on manufacturers' own published information and independent reporting available at the time of writing. They may change without notice and should be verified directly with the manufacturer before making a purchasing decision. Where a post is written ahead of hands-on testing rather than as a first-hand review, that's stated in the post itself.

Liability & insurance
Every effort is made to deliver on time and to a high standard. Mistry Arts is not liable for delays or losses caused by events outside reasonable control — illness, severe weather, equipment failure, travel disruption or similar (see "Cancellations & rescheduling" above for how this affects a booking).
Mistry Arts is not liable for indirect or consequential losses, such as lost revenue or missed opportunities. Where liability cannot reasonably be avoided, our total liability for any single project is limited to the fees paid for that project. Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, fraud, or anything else that cannot lawfully be limited or excluded under English law. If you're a consumer rather than a business, nothing in these terms affects your statutory rights under the Consumer Rights Act 2015.
Mistry Arts Ltd holds Public Liability insurance (up to £5,000,000) and Professional Indemnity insurance (up to £5,000,000). Details are available on request.
Governing law & jurisdiction
These terms, and any dispute arising from them, are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
If something goes wrong
If you're unhappy with any part of the service, get in touch at contact@niteshmistry.co.uk as soon as possible — most issues are best resolved directly and quickly, before they become a bigger problem. Please flag any concerns about delivered work within 14 days of receiving it; after that, it's treated as accepted.
General
These terms, together with the agreed quote or booking confirmation, form the whole agreement between us for a given project. If any part of these terms is found unenforceable, the rest remains in effect. Personal data collected as part of a booking is handled in line with our Privacy Policy.
Changes to these terms
These terms may be updated from time to time. The current version will always be available on this page.
